Izea has made some major changes in their oldest paid posting system. Now payperpost.com has ceased to exist and has been replaced with InPostLinks. Their dashboard is much simpler now. The opportunity page carries six notes and one of them reads, "The blog post may not be about the advertiser or include any form of review, endorsement, or testimonial about the site or product listed."

FTC Publishes Final Guides Governing Endorsements, Testimonials

Changes Affect Testimonial Advertisements, Bloggers, Celebrity Endorsements

The Federal Trade Commission today announced that it has approved final revisions to the guidance it gives to advertisers on how to keep their endorsement and testimonial ads in line with the FTC Act.

The notice incorporates several changes to the FTC’s Guides Concerning the Use of Endorsements and Testimonials in Advertising, which address endorsements by consumers, experts, organizations, and celebrities, as well as the disclosure of important connections between advertisers and endorsers. The Guides were last updated in 1980.

Under the revised Guides, advertisements that feature a consumer and convey his or her experience with a product or service as typical when that is not the case will be required to clearly disclose the results that consumers can generally expect. In contrast to the 1980 version of the Guides – which allowed advertisers to describe unusual results in a testimonial as long as they included a disclaimer such as “results not typical” – the revised Guides no longer contain this safe harbor.

The revised Guides also add new examples to illustrate the long standing principle that “material connections” (sometimes payments or free products) between advertisers and endorsers – connections that consumers would not expect – must be disclosed. These examples address what constitutes an endorsement when the message is conveyed by bloggers or other “word-of-mouth” marketers. The revised Guides specify that while decisions will be reached on a case-by-case basis, the post of a blogger who receives cash or in-kind payment to review a product is considered an endorsement. Thus, bloggers who make an endorsement must disclose the material connections they share with the seller of the product or service. Likewise, if a company refers in an advertisement to the findings of a research organization that conducted research sponsored by the company, the advertisement must disclose the connection between the advertiser and the research organization. And a paid endorsement – like any other advertisement – is deceptive if it makes false or misleading claims.

Celebrity endorsers also are addressed in the revised Guides. While the 1980 Guides did not explicitly state that endorsers as well as advertisers could be liable under the FTC Act for statements they make in an endorsement, the revised Guides reflect Commission case law and clearly state that both advertisers and endorsers may be liable for false or unsubstantiated claims made in an endorsement – or for failure to disclose material connections between the advertiser and endorsers. The revised Guides also make it clear that celebrities have a duty to disclose their relationships with advertisers when making endorsements outside the context of traditional ads, such as on talk shows or in social media.

The Guides are administrative interpretations of the law intended to help advertisers comply with the Federal Trade Commission Act; they are not binding law themselves. In any law enforcement action challenging the allegedly deceptive use of testimonials or endorsements, the Commission would have the burden of proving that the challenged conduct violates the FTC Act.

The Commission vote approving issuance of the Federal Register notice detailing the changes was 4-0. The notice will be published in the Federal Register shortly, and is available now on the FTC’s Web site as a link to this press release. Out of the country for an eight-day trip across Asia, President Obama said in his weekly address on Saturday that his travels were meant to secure help for the economy. "As we emerge from the worst recession in generations, there is nothing more important than to do everything we can to get our economy moving again and put Americans back to work, and I will go anywhere to pursue that goal," Obama said in a recorded message from Seoul. He added that increasing America's exports abroad could "help create new jobs at home and raise living standards throughout the world." Taking on the role of family budgeter in chief, he called on consumers to be wary during holiday shopping of "more and more debt," and said Americans must "spend less, save more."

A blogger who reviews a product -- but leaves out the fact that he or she got a payment, high-value gift or free vacation to write the review -- could run afoul of new federal regulations on advertising.

The blogger rules, announced today by the Federal Trade Commission, are part of revisions to the agency's Guides Concerning the Use of Endorsements and Testimonials in Advertising.

The last time these guides were revised was in 1980, and of course back then there was no such thing as a blogger.

But bloggers are mentioned several times in the 81-page revisions. "The post of a blogger who receives cash or in-kind payment to review a product is considered an endorsement," said the agency in a release. "Thus, bloggers who make an endorsement must disclose the material connections they share with the seller of the product or service."

A blogger can, however, accept a free sample of a product for review purposes without disclosure, "provided that the product itself does not have such a high value that would make its receipt material (e.g., a car)," according to the revised rules.

There's nothing in the rules that specifies how the disclosure must be made. "That's left up to the endorser," said Richard Cleland, assistant director of the FTC's division of advertising practices. "It can be a banner, part of the review. The only requirement is that it be clear and conspicuous."

The new rules go into effect Dec. 1.

There are no penalties directly associated with violating the rules. But if a blogger constantly breaks them, the FTC could seek a cease-and-desist order.

If a blogger is thus ordered but continues to break the rules, it can run into real money. The fine for violating an order is up to $11,000 per incident.

Just like with all other customization options, they recommend experimenting with each ad format for 3-4 weeks and measuring performance using custom channels.

The UK has become the first major economy where advertisers spend more on internet advertising than on television advertising, with a record £1.75bn online spend in the first six months of the year.

The milestone marks a watershed for the embattled TV industry, the leading ad medium in the UK for almost half a century. It has taken the internet little more than a decade to become the biggest advertising sector in the UK.

UK advertisers spent £1.75bn on internet advertising in the six months to the end of June, a 4.6% year-on-year increase, according to a report by the Internet Advertising Bureau and PricewaterhouseCoopers. To put this in perspective, in 1998, when the IAB first measured internet advertising, just £19.4m was spent online. Read at Guardian

For the first time, when I click LoudLaunch.com, godaddy.com opens instead. There are a lot of questions that are lingering on in my mind: Has the the domain expired? Have they closed down? And there is no way to find out. Does anyone has any ideas about what has happened to Loud Launch?
